By submitting an application and subsequently enrolling your child at NL English Academy, you acknowledge and agree to the following terms and conditions. Please read them carefully. For any questions or concerns, please contact us at [email protected] before completing an application.
1. Application and Enrolment
NL English Academy term programs operates on an application-only basis. This does not apply to holiday programs or other services (i.e Sprint Packs).
1.1. Application Review and Acceptance: Submission of an application does not guarantee enrolment. All applications are subject to review by NL English Academy.
1.2. Provision of Information: Inaccurate or incomplete information provided intentionally during the application process may result in the non-acceptance or delay of an enrolment.
1.3. Course Availability: Should your application be successful, and if the chosen course or class applied for is full, your child will be placed on a waitlist and you will be notified when placement becomes available.
1.4. Indemnification: All students and parents/guardians jointly indemnify NL English Academy against any and all claims whatsoever, whether legal, equitable, under statute or otherwise, and all other liabilities of any nature arising out of any breach of confidentiality by us or our students.
2. Payment Policy
2.1. Payment Terms: Term fees for the upcoming term are due in full by the invoice due date or as per an agreed payment plan.
2.2. GST Inclusion: All fees shall include Goods and Services Tax (GST) effective from 1 July 2023 onwards.
2.3. Resource Issuance: Lesson materials and other learning resources will only be issued upon full payment of the term fees or upon receipt of the initial payment under an approved payment plan.
2.4. Enrolment Guarantee: Should your application be successful, enrolment for accepted students is not guaranteed unless the term fee is paid in full or each payment under an approved payment plan is received before lesson commencement.
2.5. Fee Arrears: We reserve the right to suspend or terminate the enrolment of a student whose fees are in arrears.
2.6. Discounts and Fee Changes: We reserve the right to change the value of all and any discounts, and to change the cost of fees charged, at any time.
3. Attendance
3.1. Expected Attendance: Students are expected to attend all lessons for which they are enrolled.
3.2. Absence Notification and Make-up Lessons: If a student is unable to attend a scheduled lesson, NL English Academy must be notified in advance to arrange for a possible replacement lesson. A replacement lesson is not guaranteed due to the strict class capacity per class. However, a replacement lesson will be arranged subject to availability.
3.3. Make-up Lesson Requirement: Students are required to attend a make-up lesson in the same week or watch the recording of the class.
3.4. No Credits or Refunds for Missed Lessons: Credits or refunds will not be provided for any missed lessons. In cases where students are unable to attend their allocated class, best efforts will be made to reallocate them to an alternative class during the same week and provide a recording of the lesson.
3.5. Lesson Postponement/Changes: If a lesson is postponed or changes are made due to an unforeseen event (e.g. teacher's illness), the postponed lesson will be rescheduled to a later date, or a substitute teacher may conduct the lesson. A lesson recording will be made available at the end of the week.
4. Student Conduct
4.1. Behavioural Expectations: Students are always expected to maintain exemplary behaviour as per the student code of conduct.
4.2. Disruptive Behaviour: We reserve the right to suspend or terminate the enrolment of a student for any disrespectful behaviour and/or behaviour that disrupts the learning of other students.
4.3. No Credits/Refunds for Behavioural Issues: For any and all negative behaviour leading to suspension or termination, we will not offer credits or refunds for missed lessons.
5. Homework
5.1. Submission and Feedback: Students' weekly homework will be collected, marked, and returned to them in the following week.
5.2. Encouraged Submission: Weekly homework submission is not compulsory but is strongly encouraged for optimal learning.
5.3. Consistent Non-Submission: Students who consistently fail to submit homework will receive warnings and notifications to submit homework.
5.4. Commitment to Program: NL English Academy reserves the right to terminate a studentโs enrolment if their commitment to the program is found lacking.
6. Use of Images and Recordings for Marketing
6.1. Consent for Marketing Materials: You consent to the use of your child's likeness (photographs, videos, or other recordings) in marketing materials, which may include, but are not limited to, advertisements, brochures, social media posts, and promotional content. You grant NL English Academy a non-exclusive, royalty-free, worldwide, irrevocable license to use, reproduce, publish, and distribute images, videos, or recordings featuring your child for marketing and promotional purposes.
6.2. Withdrawal of Consent for Marketing: You may request in writing to withdraw consent for the use of your child's image in future marketing materials. Such withdrawal will apply only to future materials and will not affect materials already produced or distributed.
7. Lesson Recordings, Intellectual Property, and Privacy
7.1. Consent for Recordings: You consent to the recording of lessons, which may include capturing your child's image, voice, first name, and participation. These recordings serve a dual purpose: enabling students to revisit lessons for educational enrichment, and serving as proprietary content for the Academy to create commercial digital products.
7.2. Mandatory Condition: Consent for recording is a mandatory condition of enrolment in standard live classes.
7.3. Collection of Personal Details: NL English Academy requests that its students provide personal details, including school exam results, OC & Selective results & photographs which may be collected via SMS text or email.
7.4. Promotional Use of Results: NL English Academy reserves the right to advertise names, results, and photographs for promotional purposes.
7.5. Confidentiality: Each student attending NL English Academy is required to submit personal details, which are kept confidential. Any changes to this information must be updated as soon as possible.
7.6. Inaccurate Information: Inaccurate or incomplete information provided intentionally may result in the non-acceptance of an enrolment or cancellation of an existing enrolment.
7.7. Commercial License and Intellectual Property:
7.7.1. Ownership and Sale: NL English Academy retains 100% ownership of all Intellectual Property rights in the lesson recordings. You acknowledge and expressly consent that the Academy has an irrevocable, perpetual, worldwide, royalty-free license to use, edit, distribute, and commercially sell these recordings (which may include the student's face, voice, and first name) to third parties.
7.7.2. Indemnity for Third-Party Use: Once a recording is sold or distributed, NL English Academy cannot control how third-party purchasers interact with the content. You release and indemnify the Academy against any liability, privacy claims, or reputational harm arising from the authorized sale and subsequent third-party viewing of these recordings.
7.7.3. Opt-Out / Private Options: We respect the privacy of our students. If a parent or student does not wish to have their image or voice recorded for commercial sale, they must keep their camera and microphone turned off during the lesson, or contact us prior to enrolment to inquire about non-recorded class alternatives. Active participation with a camera/microphone constitutes ongoing consent.
7.7.4. Waiver of Royalties and Moral Rights: You agree that no royalties, commissions, or compensation will be paid to the student or parent for the commercial sale of the recordings. You also waive any "moral rights" to inspect or approve the final edited videos before they are sold.
7.7.5. Data Retention Period: All session recordings and supplementary materials provided during the course of tutoring are stored for a maximum period of ninety (90) days following the date of the session or the conclusion of the specific module on our internal servers. However, recordings that are selected and processed for commercial sale will be retained perpetually as commercial assets.
7.8. Disclosure of Information: We will not disclose a student's information unless the disclosure is:
7.8.1. Required by law.
7.8.2. Authorised by law.
8. Refunds
8.1. Refund Eligibility: A refund of the remaining termโs classes is available within the first 14 days from your child's first lesson.
8.1.1. Pro-Rata Calculation: The refund will be calculated at a pro-rata rate of the remaining teaching hours.
8.1.2. Payment Plan Refunds: For payment plans, students may cease their payment plan after the first payment should they wish to cease classes.
8.2. No Credits or Refunds for Missed Lessons: We will not offer credits or refunds for missed lessons.
